Terms & Conditions (EULA)

Welcome to Coralist. By downloading, installing, or using the Coralist mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. These Terms constitute a legally binding End User License Agreement (EULA) between you and the operator of Coralist.

If you do not agree to these Terms, you must not use the App.

1. License Grant and Restrictions

Coralist grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms.

You agree not to:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
• Use the App for any illegal purpose or in violation of any local, state, national, or international law.
• Circumvent or attempt to circumvent any rate limits or subscription paywalls.

2. Artificial Intelligence (AI) Disclaimer

Coralist utilizes artificial intelligence powered by Google Gemini to provide aquarium parameter analysis, livestock compatibility assessments, maintenance task suggestions, and conversational guidance.

• No Warranty of Accuracy: We do not warrant the accuracy, completeness, timeliness, or reliability of any AI-generated output. AI systems may produce incorrect, incomplete, or contextually inappropriate recommendations ("hallucinations"). You acknowledge that you use AI features entirely at your own risk.
• Biological Risk Acknowledgment: Aquarium management inherently involves biological risk. You are solely responsible for all decisions regarding your aquarium, including but not limited to chemical dosing, water changes, livestock additions, and equipment configurations. Coralist expressly disclaims liability for any livestock mortality, coral tissue loss, equipment damage, or ecological harm resulting from actions taken in reliance on AI-generated outputs, except to the extent that such damage results from our intentional misconduct or conscious recklessness (opzet of bewuste roekeloosheid).

3. Subscriptions and In-App Purchases

Coralist offers enhanced features through the following auto-renewing subscription tiers, processed by the Apple App Store or Google Play Store:

Subscription prices are displayed in your local currency within the App before purchase. Prices may vary by region and are set by the respective app store.

• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Cancellation: You may cancel your subscription at any time. To cancel:
  • Apple: Open Settings > Apple ID > Subscriptions > Coralist > Cancel Subscription.
  • Google Play: Open Google Play > Menu > Subscriptions > Coralist > Cancel Subscription.
• No Partial Refunds: Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription period. Refund requests should be directed to Apple or Google, as applicable.

4. User Accounts and Data

• Account Creation: You must provide accurate and complete information when creating an account.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.
• Account Deletion: You may request deletion of your account at any time via the App (Settings > Account Details > Delete Account). Upon requesting deletion:
  1. Your account is immediately deactivated and your data becomes inaccessible.
  2. You have a 30-day grace period during which you may restore your account by logging back in and selecting "Restore Account."
  3. After 30 days, your data is permanently and irreversibly deleted from all active databases via an automated nightly purge process.

5. Apple App Store and Google Play Store Provisions

If you downloaded the App from the Apple App Store or Google Play Store, the following terms apply:

• These Terms are concluded between you and Coralist only, not with Apple Inc. or Google LLC.
• Apple and Google have no obligation to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price for the App to you.
• Apple and Google are third-party beneficiaries of these Terms, and upon your acceptance, they will have the right to enforce these Terms against you.

6. Limitation of Liability

6.1 Nothing in these Terms excludes or limits our liability for (a) damages caused by intentional misconduct (opzet) or conscious recklessness (bewuste roekeloosheid) on our part; (b) death or personal injury caused by our negligence; or (c) any other liability that cannot be excluded or limited under applicable Dutch or EU law.

6.2 Subject to Section 6.1, our total aggregate liability to you for all claims arising out of or relating to the use of the App shall not exceed the greater of (a) the total subscription fees you have paid to Coralist in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty euros (€ 50).

6.3 Subject to Section 6.1, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or aquarium livestock, arising out of or relating to the use of, or inability to use, the App.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands, subject to mandatory consumer protection provisions that may grant you the right to bring proceedings in your jurisdiction of residence.
